1. Acceptance of terms

These Terms of Service (“Terms”) form a legally binding contract between you (“User”, “you”, or “your”) and Hunarmind Technologies (“SmartRank”, “Company”, “we”, “us”, or “our”), the operator of the SmartRank platform accessible via thesmartrank.com and associated applications.

By accessing, browsing, registering for, or utilizing any portion of our platform, you acknowledge that you have read, understood, and agreed to be governed by these Terms and our Privacy Policy. If you do not accept these Terms, you must discontinue use of the platform immediately.

2. Services description

SmartRank provides an intelligent exam preparation and performance analytics ecosystem for candidates preparing for competitive examinations (including UPSC, SSC, Banking, Railways, State PSCs, and related assessments).

Our core offerings include:

• Algorithmic study schedules and diagnostic roadmaps personalized to your target exam and preparation timeframe.
• Computer-based mock tests, sectional tests, and previous year question (PYQ) practice modules with timed environments.
• AI-assisted explanations, concept summaries, and learning assistant dialogues.
• Percentile rankings, subject-level weakness diagnostics, and predictive rank trajectories.

We continually enhance our services and reserve the right to modify, expand, suspend, or discontinue any feature with reasonable notice where feasible.

3. User accounts & registration

To utilize customized study plans and practice modules, you must create an account. When creating your account, you agree to:

• Provide accurate, current, and complete registration information.
• Maintain the confidentiality of your credentials and restrict unauthorized access to your account.
• Promptly notify SmartRank at support@thesmartrank.com if you suspect or detect any unauthorized access or breach of security.
• Refrain from sharing account access, licenses, or Exam Simulator tokens with third parties.

You must be at least 13 years of age (or the minimum legal age required in your jurisdiction) to use our platform. Users under 18 years of age should review these Terms under the supervision of a parent or guardian.

4. Subscriptions & payments

SmartRank provides both complimentary tier access and paid subscription plans (including monthly, annual, or exam-specific passes).

• Billing: Fees for paid tiers are billed in advance on a recurring or one-time basis according to the selected plan. All displayed prices are subject to applicable taxes.
• Payment Processing: Transactions are securely processed through certified third-party payment gateways. We do not store sensitive payment card credentials on our servers.
• Cancellation: You may cancel your subscription at any time through your account billing settings. Cancellation takes effect at the conclusion of the active billing cycle.
• Refunds: Unless required by local consumer legislation, subscription payments are non-refundable once digital mock tests or AI evaluation resources have been consumed.

5. Intellectual property rights

All proprietary algorithms, question banks, explanations, platform designs, trademarks, logos, texts, software code, and interface assets remain the exclusive intellectual property of Hunarmind Technologies.

SmartRank grants you a personal, non-transferable, revocable, and non-exclusive license to access and utilize study materials solely for your individual, non-commercial exam preparation. You may not republish, distribute, sell, scrape, or modify any platform content without prior written permission.

6. Acceptable use policy

When utilizing SmartRank, you agree not to:

• Use automated tools, crawlers, robots, or scrapers to extract mock questions, solutions, or platform analytics.
• Reverse engineer, decompile, or attempt to extract source code or underlying neural weights from our platform.
• Bypass rate limits, security barriers, authentication mechanisms, or billing gates.
• Transmit any virus, malware, or destructive code.
• Engage in abusive, harassing, or disruptive behavior towards platform staff or other learners.

7. AI features & educational disclaimer

SmartRank employs generative AI, natural language processing, and probabilistic statistical algorithms to curate personalized study roadmaps, suggest focus areas, and compute estimated rank percentiles.

While we strive for high accuracy, AI explanations may occasionally contain oversights. Learners are encouraged to cross-reference primary syllabi and standard textbooks for critical revision.

8. User content & submissions

You retain ownership of any notes, annotations, diagnostic answers, or feedback you submit on SmartRank. By submitting content or feedback, you grant SmartRank a worldwide, royalty-free license to use anonymized performance metrics to improve analytical models, question recommendations, and platform reliability.

9. Third-party services & links

The platform may integrate with third-party tools (such as authentication providers, cloud storage, or external exam notification feeds). SmartRank is not responsible for the availability, content, or data practices of external third-party services.

10. Disclaimers & limitation of liability

The SmartRank platform and all associated materials are delivered on an “as is” and “as available” basis without warranties of any kind, either express or implied.

To the fullest extent permitted by applicable law, Hunarmind Technologies shall not be held liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, loss of exam opportunity, or preparation interruption arising from the use or inability to use the platform.

11. Termination & suspension

SmartRank reserves the right to suspend or terminate your account and access to the platform without prior notice if you breach these Terms, engage in fraud, or compromise system stability. You may close your account at any time by contacting our support desk.

12. Governing law & dispute resolution

These Terms shall be governed by and construed in accordance with the laws of India, without regard to conflict of law principles. Any dispute arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts located in New Delhi, India.
